New regulation on trademark invalidity and revocation
The new regulation of Trademark Law (Royal Decree-Law 23/2018, of 21 December, on the transposition of directives concerning trademarks, railway transport, combined trips and related travel services) has amended current Trademarks Law 17/2001, of 7 December, and made material amendments to it.
One of the important changes is the direct administrative competence of the Spanish Patents and Trademarks Office (OEPM, in Spanish) to coordinate applications and declare the invalidity or revocation of registered trademarks or commercial names.
This is a significant change in the regulation of trademark invalidity and revocation declarations since, once this amendment becomes effective, the Spanish Patents and Trademarks Office may declare the invalidity and revocation of a trademark without resorting to the courts of justice.
This amendment to the Trademarks Law will become effective on 14 January 2023.
A trademark registration may be declared to be invalid by filing an application with the Spanish Patents and Trademarks Office or through a counterclaim in an action for trademark infringement.
A trademark revocation may be declared by filing an application with the Spanish Patents and Trademarks Office or through a counterclaim in an action for trademark infringement.
Once the invalidity or revocation application is received, the Spanish Patents and Trademarks Office will serve it to the owner of the challenged trademark, so that it may file allegations and evidence within the statutory term. During the examination of the invalidity or revocation application, the Office may request the parties, as many times as necessary, to answer the allegations or evidence submitted by the other party within the statutory term.
